Die verhoor oor die dubbele moord op twee senior bestuurslede van die Namibië Instituut vir Mynbou en Tegnologie (Nimt) in 2019 het in die hoërhof in Windhoek hervat, maar is kort daarna kortgeknip nadat regter Christie Liebenberg in kennis gestel is dat die hof se bandopnemer nie die oggend se verrigtinge opgeneem het nie.

Die 59-jarige mnr. Ernst Josef Lichtenstrasser staan tereg op twee klagte van moord en ses ander klagte wat verband hou met die onwettige besit van 'n vuurwapen en ammunisie, asook regsverydeling deurdat hy na bewering die 9mm-rewolwer daarna in die woestyn begrawe het.

Hy word daarvan beskuldig dat hy Nimt se uitvoerende ­direkteur, mnr. Eckhart Mueller (72), en sy adjunk, mnr. Heimo Hellwig (60), op 15 April 2019 op die Arandis-kampus dood­geskiet het.

Gister het 'n adjudant-offisier van die Namibiese polisie oor die hantering van bewysstukke getuig.

'n Rewolwer, lewendige ammunisie, 'n bruin geweerholster en swart werkstewels vorm deel van die bewysstukke waarop die polisie beslag gelê het.

Lichtenstrasser se regsverteenwoordiger, mnr. Albert Titus, was goed op dreef met kruisondervraging toe die hof 'n pouse vir middagete geneem het.

Met aankoms by die hof omstreeks 14:15 vir die voortsetting van kruisondervraging, is die partye van die foutiewe bandopnemer ingelig. Liebenberg het voorgestel dat hulle eers luister tot waar die toestel opgeneem het en die volgende dag besluit hoe hulle sal voortgaan.

Die verhoor is intussen na 'n ander hofsaal geskuif.

Die hofopnames is belangrik sodat dit vir die rekord getranskribeer kan word.

“Ons sal môre hoor tot waar dit opgeneem het, maar ek weet nie of ons vandag se hofverrigtinge sal moet herhaal nie,” het Titus aan Republikein gesê.

Voordat die staatsgetuie gister die getuiebank betree het, het Titus die hof in kennis gestel dat Lichtenstrasser glo in April 2019 onwettig aangehou is. Hy het die hof versoek om sy kliënt op borgtog of met 'n waarskuwing vry te laat.

Wet op kriminele prosedures

Lichtenstrasser beweer dat hy op 16 April in hegtenis geneem is en weer op 18 April vrygelaat is sonder klagte teen hom.

Hy is glo op 23 April opnuut in ­hegtenis geneem, maar het eers op 9 Mei vir die eerste keer in die landdroshof op Swakopmund verskyn.

Volgens die wet op kriminele prosedures moet beskuldigdes binne 48 uur ná inhegtenisneming voor 'n regter verskyn.

Liebenberg het beslis dat die verdediging nie voldoende bewyse hiervan ingedien het nie en hy het die aansoek van die hand gewys.
